Using NEPA as a vehicle to regulate and monitor hydraulic fracturing operations is an interesting approach. It certainly has the benefit of operating at a national level, as opposed to more piecemeal solutions. One concern is that NEPA is oriented towards broader environmental impact assessments, as opposed to climate impacts in particular, so it may not adequately address the climate element of hydraulic fracturing. A second concern relates to the political feasibility of the changes suggested here. The proposal says little about the political strategy for passing these policies, although the prospects for political action on hydraulic fracturing at the federal level seem relatively dim at the moment. Nonetheless, it was interesting idea to read and consider.
